The formal complaint procedure is initiated by the complainant lodging with a sexual harassment policy coordinator a written, signed complaint, containing the relevant allegations against the respondent, i.e., the person against whom the complaint is made. (There may be multiple complainants and/or respondents.)
Where the respondent is a student, the complaint will be handled by the disciplinary procedures described in the Student Handbook. If the respondent is not a student, the coordinator will notify the complainant and the respondent, providing the latter with a copy of the complaint, and will convene a committee of investigation. An experienced sexual harassment advisor will serve as the non-voting moderator of the committee of investigation. (A student complainant has the right to waive the presence of students as members of the committee.)
The function of the committee of investigation is to conduct a thorough investigation of the allegations in the complaint, with a view to (a) determining whether any conduct alleged in the complaint did occur in the manner and circumstances alleged or otherwise; and (b), to the extent that alleged conduct did occur, whether that conduct constitutes sexual harassment.
When sexual harassment is determined to have occurred, the committee of investigation shall recommend appropriate action.
In the conduct of its investigation, the committee of investigation will hold a hearing (which, in the interest of confidentiality, is not public). The committee will make available to the complainant and the respondent before the hearing, in confidence, the documentation it considers relevant.
After concluding its investigation, the committee of investigation prepares a report containing its findings and recommendations. The coordinator will then evaluate the findings in the report, and take or recommend appropriate action, in accordance with this Policy and the applicable university policies.
A detailed account of the procedures for a formal complaint, summarized here, is part of the full text of this Policy, and is available from any one of the sexual harassment advisors or from the office of any one of the coordinators, listed above. Persons considering a decision to lodge a formal complaint are urged to acquaint themselves with those detailed provisions.
