POSITION RESPONSIBLE FOR REVIEW: Director, Business Operations

 

PURPOSE: To establish a policy and procedures for hours of work for FMS staff members.

BACKGROUND: FMS sets a variety of hours of work for its staff members, determined by its departmental responsibilities, by the nature of their staff work assignments, and by REFERENCES 1 and 2.

POLICY: FMS policy is to set hours of work that comply with REFERENCES 1 and 2, and that enable FMS to carry out its mission of support for the campus community.

PROCEDURES:

1. Work Week The work week for the university and for FMS is a continuous time period that begins at 12:00.01 a.m. every Monday.

1.1. Based on REFERENCE 1, the normal work week for regular full-time non-bargaining unit staff members, both exempt and nonexempt, is 37.5 hours per week. (See REFERENCE 1 for an explanation of exempt/nonexempt status.)

1.2. Based on REFERENCE 2, the normal work week for bargaining unit staff members is 40 hours consisting of five consecutive work days, and two days off. The normal work week for bargaining unit members also may be four consecutive ten-hour work days, and three days off, according to schedules set by FMS management. REFERENCE 3 explains these practices for bargaining unit members assigned to the Housing Crew.

1.3. Based on REFERENCE 4, the normal work week for locksmiths is 40 hours Monday through Friday.

2. Normal Work Days and Hours Normal work days for the university are Monday through Friday, and normal working hours or business hours are 8:30 a.m. to 5 p.m. For FMS, the normal work day or regular daylight shift occurs Monday through Friday, between 6:30 a.m. and 5 p.m.

2.1. The normal work day for nonexempt staff members is 7.5 hours, from 8:00 a.m. to 4:30 p.m., with an unscheduled unpaid meal period and not more than two unscheduled paid breaks not to exceed 15 minutes each. Staff members may request different beginning and ending times, between 6:30 a.m. and 6:30 p.m., to accommodate individual and customer needs. Their supervisors may approve such requests, provided that the assigned work allows flexible scheduling.

2.2. The normal work day for bargaining unit members and locksmiths on a daylight shift is either 8 hours or 10 hours, occuring between 6:30 a.m. and 5 p.m., with a scheduled unpaid one-half hour lunch period, and with either one or two scheduled, paid relief periods, not to exceed 30 minutes in total.

2.3. Exempt staff members are expected to carry out their responsibilities in a complete and timely way, and to be available or to be engaged in work-related activity during at least a substantial majority of normal working hours of the university and/or of the people they supervise, without reference to a normal work week or work day.

3. Non-Business Hours Selected members of certain job classifications in the bargaining unit work regularly scheduled shifts on weekends and during non-business hours before 8:30 a.m. and after 5 p.m. Monday through Friday, to provide necessary coverage for critical services provided by FMS. (See REFERENCE 5 for information on services and procedures during non-business hours.) The normal work day for these schedules, including lunch and break provisions, is determined based on REFERENCE 2. FMS schedules may include air conditioning and electrical services during non-business hours between 6:30 a.m. and midnight Monday through Friday, and between 7:30 a.m. and midnight on weekends, 52 weeks per year, and heating and plumbing services between 7:30 a.m. and midnight seven days per week, 52 weeks per year.

4. Extra Hours These are hours outside the normal work day for nonexempt or bargaining unit staff members, whether or not paid, and if paid, whether at regular rates or at overtime rates. (FMS staff members in exempt positions do not record, and are not compensated for, extra hours of any sort.)

4.1. Extra hours for nonexempt non-bargaining unit staff members are based on REFERENCE 1. They consist of hours worked over 37.5 in one work week. The hours between 37.5 and 40 are paid at regular rates; hours over 40 are paid at one and one-half times regular rates (a.k.a. "overtime" rates). Hours paid for designated university holidays are counted in the hours worked total for overtime calculations. Compensatory time off (a.k.a. "comp time") during a work week (see REFERENCE 5) will reduce the total hours worked in that work week, and accordingly will reduce the amount, if any, that is to be paid for extra hours.

4.2. Extra hours and pay calculations for bargaining unit members are based on REFERENCE 2, and on the procedures found in REFERENCE 6; for locksmiths, they are based on REFERENCE 4.

 

5. Changes

5.1. Staff members present requests for changes to their normal hours or work schedules to their supervisors. These requests may be for compensatory time off during a work week when extra hours are worked or scheduled, changes in the length of the work day and the work week, and in beginning and ending times during the normal work day. The requested change may be either temporary or permanent.

5.2. Supervisors, according to FMS work requirements, may change temporarily the overall work schedule, normal hours and days, and non-business hours, and they may assign extra hours. They also recommend action by the director on permanent changes requested by the staff members they supervise. Directors may change permanently the work schedule, normal hours and days, and non-business hours, for an individual position.

5.3. Change requests and changes are in writing, with appropriate signatures.

RESPONSIBILITIES:

1. All FMS staff members are responsible to be aware of the topics addressed in this directive, and to consult it and any applicable references prior to initiating an inquiry related to any of these topics.

2. Supervisors are responsible for applying the foregoing hours of work procedures, and for acting on requests for modifications for which it makes provisions. Supervisors are responsible for using the information found in REFERENCE 7.

3. Directors are responsible to set work schedules, normal hours and days, and non-business hours. They review the implementation of these hours of work, and they propose or act on changes in those hours that support the FMS mission.
