What portions of a scholarship/fellowship are taxable to the recipient?
- the award is a "qualified scholarship"
- the recipient is a "candidate for a degree," and
- the award is for the purpose of studying or conducting research at an "educational organization".
In order to constitute a "qualified scholarship," the amount must be paid for:
- tuition and fees required for enrollment or attendance at the educational institution, or
- fees, books, supplies, or equipment required for courses of instruction at the institution.
Amounts paid for expenses such as room, board, living allowances, travel, research and clerical help (as well as equipment and other expenses not required for enrollment or attendance) are taxable to the recipient. A "candidate for a degree" is someone who is in a degree seeking program, as well as someone who is not in a degree program but attends an institution that grants degrees. Finally, in order to qualify as an "educational organization," the Code requires that the institution must be one that "normally maintains a regular faculty and curriculum and normally has a regularly enrolled student body of pupils in attendance at the place where its educational activities are carried on."
